It’s now been reported that Olivier Martinez has decided not to embark upon a custody war with Halle Berry over their two-year-old son Maceo, according to TMZ.The French filmmaker is allegedly planning to file for joint custody of their child because he doesn’t want to go through the same stress Halle and her ex Gabriel Aubry endured over their daughter Nahla, now seven.

It’s been well reported in the past that Martinez was keen to live in his native France with Berry and their baby boy but plans to relocate were halted as a result of the actress’ nasty custody fight with her ex.
Not staying in: On Wednesday Olivier Martinez was spotted for the first time since news broke the day before his wife Halle Berry had filed for divorce after only two years of marriage; TMZ claimed he was heading to her home for a brief visit.
It’s over: Berry and Martinez, seen in June 2012, issued a joint statement on their split, saying: ‘It is with a heavy heart that we have come to the decision to divorce’.
A $5 million lawsuit was filed in mid-October against both Halle and Martinez for the attack.
